The “Sandbagger Long Weekend Sweepstakes” (the “Sweepstakes”)

Official Rules 

 

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

THE SWEEPSTAKES IS ONLY OPEN TO LEGAL RESIDENTS OF THE STATE OF NEW YORK AND THE STATE OF NEVADA WHO ARE AT LEAST TWENTY-ONE (21) YEARS OF AGE OR OLDER AT THE TIME OF ENTRY. SWEEPSTAKES WILL BE GOVERNED BY UNITED STATES LAW. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

1. ELIGIBILITY: The “Sandbagger Long Weekend Sweepstakes” (the “Sweepstakes”) is open to legal residents of the state of New York and the state of Nevada and in both instances entrants must be twenty-one (21) years of age or older at the time of Entry and awarding of the Prize if applicable, are a registered users of Instagram (as further defined in Section 4 below) and have a valid email account. Employees, officers and directors of the following entities and members of their immediate families (defined as spouse, parent, child, or sibling; whether biological, adopted, step or in-law) or same households (whether related or not) are NOT eligible to participate in the Sweepstakes or win the Prize, including SANDBAGGER HOLDINGS USA (the “Sponsor”), its parent company, subsidiaries, divisions, affiliates, advertising and sweepstake agencies, as well as alcohol beverage licensees (i.e., alcohol beverage suppliers, importers, wholesalers, distributors and retailers). Groups, clubs, organizations, businesses and commercial and non-commercial entities cannot participate. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void outside eligibility area, where prohibited or restricted by law. 

 

2. AGREEMENT TO THE RULES: By entering, all entrants agree that they have read these Official Rules, the Instagram terms and policies, and agree to abide by and to be bound by the terms and conditions of the Official Rules (“Official Rules”), Instagram terms and policies and the decisions of Sponsor which shall be final and binding in all respects related to this Sweepstakes. Winning the Prize is contingent upon fulfilling all requirements as set forth herein.

 

3. SWEEPSTAKES PERIOD: Sweepstakes begins at 10:00:00 a.m. Eastern Daylight Time (“EDT”) on July 4, 2025, and ends at 11:59:59 p.m. EDT on July 21, 2025 (the “Sweepstakes Period”). Sponsor’s computer is the official time-keeping device for this Sweepstakes.

 

4. HOW TO ENTER: No Purchase Necessary. To participate in the Sweepstakes, you must have internet access, an Instagram account (set to public), and if selected as a potential winner a valid email account.

 

There is no fee or charge to set up an account and become a registered user of Instagram. If you don’t already have an Instagram account, visit https://www.instagram.com/ (“Instagram”) and follow the directions to create an account, subject to the Terms of Instagram including but not limited to Instagram’s Terms of Use (found at https://help.instagram.com/, select “Terms and Policies”). By submitting your information and creating an account, you agree to the respective terms of use and privacy notice of Instagram. If you chose to use your mobile device, you may require a compatible mobile device and download the Instagram “app”. If you do not agree to such terms of use and privacy notice, you cannot create an Instagram account. Once you become a member of Instagram, log into your account and set your account to “public” for the duration of the Sweepstakes and winner announcement, in order to participate in the Sweepstakes. If you choose to keep your settings to “private” during the Sweepstakes period and winner announcement, you cannot participate in the Sweepstakes. You can return your account to “private” any time after the winner announcement.

Entrants can enter the Sweepstakes during the Sweepstakes Period as follows:

 

a. Access the official Sandbagger USA Instagram page at https://www.instagram.com/sandbaggerusa (@SandbaggerUSA);

b. Make sure your Instagram account is set to "public";

c. You must follow @SandbaggerUSA (If you are not already following);

d. Like the SandbaggarUSA Sweepstakes Post;

e. Save the SandbaggarUSA Sweepstakes Post;

f. Leave your personal comment to the question posed within the Sweepstakes Post;

g. Tag one (1) Friend (as further defined in Section 5 below) whom is a legal resident of the state of New York or the state of Nevada and is 21 years of age or older, whom is personally known to you and who you believe may have interest in Sandbagger Hard Seltzer products. 

h. In addition, you must ensure you have obtained your friend’s consent beforehand. THE SPONSOR IS DIRECTLY RELYING ON THE ENTRANT’S REPRESENTATION THAT HIS/HER TAGGED FRIEND IS A RESIDENT OF THE STATE OF NEW YORK OR THE STATE OF NEVADA AND IS 21 YEARS OF AGE OF OLDER; IF THE SPONSOR DETERMINES THAT THIS IS NOT ACCURATE, THE SPONSOR WILL DISQUALIFY THE ENTRANT FROM THE SWEEPSTAKES, PROHIBIT HIM/HER FROM PARTICIPATING IN FUTURE SWEEPSTAKES OFFERED BY THE SPONSOR AND OTHERWISE SEEK TO PROTECT ITS LEGAL RIGHTS.

i. All entry information, comments; captions, tagged Friend shall be collectively referred to herein as an “Entry”. 

j. By submitting your Entry; you agree that: (1) your Entry conforms to any terms of use/platform guidelines, policies and content restrictions of Instagram (as applicable); (2) your username and profile picture may be posted on Instagram and/or Sponsor’s proprietary website and/or social pages, where it may be viewed, shared (by users of social media and various other internet-based sites) and commented on by the Sponsor and the general public; (3) conforms to the Entry and Content Restrictions as further defined in Section 6 below; and (4) Sponsor/Administrator, in their sole discretion, and without notice, may disqualify you from the Sweepstakes if they determine that your Entry fails to conform to these Official Rules including without limitation the Entry and Content Restrictions as further defined in Section 6 below.

k. Refer to Section 7 for Entry limits and restrictions.

If you choose to use Instagram via your mobile device you may be charged for standard data rates according to the terms and conditions in your agreement with your wireless carrier. You agree to incur at your sole cost any and all charges demanded by your wireless carrier. You should also check your device's features for capabilities and check the device manual for specific use instructions.

The person submitting the Entry must be the authorized account holder of such Instagram account, otherwise the Entry may be deemed void. In the event of a dispute over the identity of an entrant and if applicable potential winner, the Entry will be declared made by the authorized holder of the Instagram account used for Entry, and if applicable the potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder of such Instagram account. The “authorized account holder” is the natural person assigned to the applicable Instagram account by Instagram. It is the sole responsibility of the entrant to notify the Sponsor in writing if the entrant changes his or her Instagram account during the duration of the Sweepstakes. Proof of submission of an Entry does not constitute proof of delivery of Entry. Multiple accounts may not be used, and anyone found to use multiple accounts to enter will be deemed ineligible. 

 

Each Entry must be manually keystroked and manually entered by the individual entrant; automated and/or repetitive electronic submission of entries (including, but not limited to, entries made using any script, macro, bot or service) will be disqualified and transmissions from these accounts or related email or IP addresses may be blocked. By submitting an Entry in this Sweepstakes, entrant agrees to comply with these Official Rules. Entries that do not comply with these Official Rules, as determined in Sponsor and/or Administrator’s in their sole discretion will be disqualified from the Sweepstakes. Decisions of the Sponsor and/or Administrator are final and binding. Each entrant hereby represents and warrants that he/she is the original author/creator of his/her Entry and the Entry will not infringe any third party's copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy. Sponsor's use of information submitted to Sponsor in connection with this Sweepstakes will be subject to the terms and conditions of these Official Rules.
 

5. TAGGING A FRIEND GUIDELINES AND ELIGIBILITY: Each personal friend or family member that you tag must be a legal resident of the state of New York or the state of Nevada and in both instances must be twenty-one (21) years of age or older at the time of being tagged. Reminder, do not tag yourself or more than one (1) friend per comment as it will result in the Entry being disqualified. 

a. A “personal friend” is defined as an individual with whom you have direct voluntary two-way communications and with whom it is reasonable to conclude that you have a personal relationship considering sharing of interests, experiences, opinions and other relevant factors. 

b. A “family member” is defined as an individual with whom you are related by marriage, common-law partnership or legal parent-child relationship and with whom you have direct voluntary two-way communication. 

c. In these Official Rules, a personal friend or family member who is tagged is called a “Friend”. 

 

6. ENTRY AND CONTENT RESTRICTIONS: 

a. The Entry must not contain material that violates or infringes another's rights, including but not limited to privacy, publicity, copyright, trademark or other intellectual property rights; 

b. The Entry must not disparage or embarrass Sponsor, their respective officers, directors, employees, or any other person or party affiliated with the Sweepstakes and administration of this Sweepstakes;

c. The Entry must not feature brand names or trademarks of others;

d. The Entry must not contain material that is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous or libelous;

e. The Entry must not contain any materials relating to lotteries, gambling, tobacco, alcohol or drugs, pornography, adult-oriented content or any other sexually-explicit material;

f. The Entry must not contain anything that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and

g. The Entry must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where Entry is created.

Failure of any Entry to comply with the above Entry Content Restrictions, as determined by Sponsor, in its sole discretion, may result in disqualification of entrant. Without limitation, Sponsor reserves the right in its sole discretion to disqualify any Entry that, at its sole opinion, refers, depicts or in any way reflects negatively upon the Sponsor, the Sweepstakes or any other person or entity, does not comply with these Official Rules or if Sponsor receives notification about any potential infringements or breaches of law or any other reason set forth herein. Entries must be suitable for presentation in a public forum, in the sole determination of Sponsor.

 

7. ENTRY LIMIT: Limit of five (5) entries per person/account during the Sweepstakes Period and each Entry must have a different comment to the question and a different Friend tagged, regardless of the number of Instagram accounts that a person has. For greater certainty and the avoidance of any doubt, you can only use one (1) personal Instagram account to enter the Sweepstakes and such account may only be used by one (1) person regardless of whether the account is shared by two (2) or more people. For clarity during the Sweepstakes Period a person can respond to the Question up to five (5) different times and each comment must be different and have a different Friend tagged. Entries that contain more than one (1) Friend tagged; has the same Friend tagged by the entrant more than once; or if you tagged yourself, the Entry or Entries in question will be disqualified. Under no circumstances will any participant be eligible to earn more than five (5) Entries during the Sweepstakes Period. No person shall submit an Entry using a business account. The Sponsor reserves the right to void all Entries (and disqualify Entrant from the Sweepstakes altogether as well as to prohibit such entrant from participating in future sweepstakes offered by the Sponsor), if the Sponsor determines in its sole discretion that a given person has engaged in egregious, blatant or repeated violations of the Entry limit. Proof of submission of an Entry does not constitute proof of receipt of same or proof of Entry. Receipt of Entry may be acknowledged (including via comment posted by Sponsor @SandbaggerUSA in response to comment posted by an Entrant) but such acknowledgment does not constitute any representation of eligibility for the Sweepstakes nor is it otherwise binding upon Sponsor. 

 

8. PRIZE: There is one (1) prize package available to be won during the Sweepstakes Period, and consists of one (1) branded Sandbagger Cornhole game [fabricated in wood with an approximate size of 24” w x 48” l] with a total of eight (8) bags [4 of each color] and four (4) Sandbagger baseball hats, and one (1) $100 Visa Gift Card (the “Prize”). The approximate retail value (“ARV”) of the Prize is $460.00 USD. NOTE: There is no alcohol included in the Prize. Prize may not be exactly as illustrated.

 

9. Prize conditions: Without limiting the generality of the foregoing, the Prize must be accepted as awarded and is not transferable, assignable or convertible to cash. No substitutions except at Sponsor’s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute the Prize or any component thereof with an item or items of equal or greater retail value, including, without limitation, but at Sponsor’s sole and absolute discretion, a cash award. The Prize will only be awarded to the person whose verifiable full name and valid email address appears on the Account associated with the Entry in question. It is anticipated that the Prize will be sent to the confirmed winner’s address as indicated on his/her Affidavit (Note: No PO Box accepted) within thirty (30) days of receipt of the Affidavit and confirmation of the eligible winner as a winner in accordance with these Official Rules (as further defined in Section 10 below). If the Prize is returned as undeliverable for any reason whatsoever, the winner will forfeit his/her Prize and the Prize will not be re-awarded nor re-delivered at a later date. All taxes including, without limitation, federal, state and local taxes (including, but not limited to income and withholding taxes), and any other expenses not specifically included in the Prize description are the sole and exclusive responsibility of the winner. Note: Sweepstakes winnings should be reported to the Internal Revenue Service and winner can expect to receive a 1099 tax form for the Prize which totals more than $600.00 USD for the year if applicable.

 

None of the Released Parties make any representation or offers any warranty, express or implied, as to the quality or fitness of the Prize or any component of the Prize awarded in connection with the Sweepstakes. To the fullest extent permitted by applicable law, the confirmed winner understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from neither the Sponsor nor any of the Released Parties should the Prize or any portion thereof fails to be fit for its purpose or is in any way unsatisfactory. Without limiting the generality of the foregoing, the Prize is provided “as is” without warranty of any kind, either express or implied, and released parties hereby disclaim all such warranties, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose and/or non-infringement. For greater certainty and the avoidance of any doubt, by accepting the Prize, the confirmed winner agrees to waive all recourse against the Released Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part.

 

9. SWEEPSTAKES DRAWING: One (1) potential winner will be selected in a random drawing to be held on or about July 22, 2025 at 10:00 a.m. EDT, from among all eligible Entries received by Sponsor, whose decisions are final in all matters relating to this Sweepstakes. Odds of winning depending on the total number of eligible Entries received during the Sweepstakes Period.

 

10. WINNER NOTIFICATION: The potential winner will be notified by direct message from @SandbaggerUSA Instagram account within forty-eight (48) hours of the sweepstakes draw date. The potential winner will be required to respond to the direct message notification within forty-eight (48) hours indicating their full name and email account. It is the individual’s responsibility to assure that their Instagram privacy settings allow for @SandbaggerUSA to notify them via direct message including setting his/her Instagram profile to “public”. The potential winner must meet all eligibility requirements and may be required to provide proof of identification and/or print, sign and return an Affidavit of Eligibility and Liability Release and; where legal, a Publicity Release (collectively the “Affidavit”). The Affidavit must be returned to the Sponsor by the date stated in the notification email or the Prize will be forfeited and awarded to an alternate potential winner. By accepting the Prize, the winner represents and warrants they are in compliance with these Official Rules. If the potential winner (i) cannot be contacted after a reasonable attempt has been made (as determined in Sponsor’s sole discretion); or (ii) fails to timely return the completed Affidavit within the time specified; or (iii) refuses the Prize; or (iv) the Prize or Prize notification is rejected or returned as undeliverable, then such potential winner will be disqualified and forfeits all rights to be deemed a winner and an alternate potential winner will be notified, time permitting. Upon Prize forfeiture, no compensation will be given. Any alternate potential winner selected will also be required to respond to the notification within the time frame stated above. 

 

11. LIMITATIONS OF LIABILITY AND RELEASE: The Sponsor and its parent, subsidiary and affiliated companies, Instagram, advertising and sweepstakes agencies, and their respective officers, directors, employees, wholesale distributors, representatives and agents (collectively the “Released Parties”) are not responsible for lost, late, misdirected, unintelligible, returned or undelivered Entries, telephone calls, text messages, email, or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website, or other connections availability, accessibility or traffic congestion, miscommunications, failed computer, network, telephone, satellite or cable hardware or software or lines, or technical failure, or jumbled, scrambled, delayed or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network. Persons who tamper with or abuse any aspect of this Sweepstakes or Website, or act in violation of the Official Rules, or act in any manner to threaten or abuse or harass any person, or violate Website’s terms of service, as solely determined by the Sponsor will be disqualified. Released Parties are not responsible for any incorrect or inaccurate information whether caused by Website users, tampering, hacking, or by any of the programming or equipment associated with or used in this Sweepstakes, and assumes no responsibility for any errors, omission, deletion, interruption or delay in operation or transmission or communication line failure, theft or destruction or unauthorized website access. Any use of robotic, macro, automatic, programmed or like entry methods will void all such Entries, and may subject that entrant to disqualification. Released Parties are not responsible for injury or damage to entrants or any other person’s computer, or property related to or resulting from participating in this Sweepstakes. Should any portion of Sweepstakes be, in the Sponsor’s sole opinion, compromised by virus, worms, bugs, unauthorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair administration, security, fairness or proper play of this Sweepstakes, or submission of Entries, Sponsor reserves the right in their sole discretion to suspend, modify or terminate the Sweepstakes, and randomly select the winner from valid Entries received prior to action taken, or otherwise as may be deemed fair and equitable by the Sponsor. 

 

Entrants agree: (a) the Released Parties, will have no liability whatsoever for, and are released and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, to persons, including death, or property, or rights of publicity or privacy, defamation, copyright infringement or portrayal in a false light resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the Prize or participation in this Sweepstakes or in any Sweepstakes-related activity, and (b) winner, by acceptance of the Prize, except where legally prohibited, grants permission for Sponsor (and agrees to confirm such agreement in writing) and those acting pursuant to its authority to use his/her name, submitted biography, voice and/or likeness and prize information, and/or Entry (and assign the Entry, which may be altered, changed, modified, edited, used alone or with other works, as solely determined by Sponsor) for advertising, trade and Sweepstakes purposes without further compensation, at any times or time, in all media now known or hereafter discovered worldwide and on the Internet without notice or review or approval.

 

12. PUBLICITY RIGHTS: By participating in the Sweepstakes and/or accepting the Prize if applicable, each entrant agrees to allow Sponsor and Sponsor’s designee the perpetual right to use his/her name, biographical information, photos and likeness, voice recording, video images and all related footage, and statements for promotion, trade, commercial, advertising and publicity purposes, at any time or times, in all media now known or hereafter discovered worldwide, including but not limited to television (including live television), radio, and Internet, without notice, review or approval and without additional compensation except where prohibited by law.

 

13. DISPUTE RESOLUTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, or any claim or dispute that has arisen or may arise between you and Sponsor, shall be governed by, and construed in accordance with, the laws of the State of Nevada without giving effect to any choice of law or conflict of law rules. The place of arbitration shall be Las Vegas, Nevada.

 

14. PRIVACY POLICY: The information you submit in connection with this Sweepstakes may be used by Sponsor for purposes of administration and fulfillment of the Sweepstakes, and in accordance with Sponsor’s privacy policy located at https://www.sandbagger.com/privacypolicy. If you are verified as the prize winner, your first name, last initial, city and state will be included in a publicly available winner’s list.

17. OFFICIAL RULES: The Official Rules of the Sweepstakes are available for viewing at https://www.sandbagger.com/contestrules during the Sweepstakes Period. 

 

18. WINNER’S LIST: For the name of the winner, send an email to info@sandbagger.com with the subject heading: @SandbaggerUSA Long Weekend Sweepstakes and in the body of the email include your full name and mailing address for receipt within sixty (60) days after the end date of the Sweepstakes Period and the Sponsor will respond to your email with the name of the winner. 

 

19. This Sweepstakes is in no way sponsored, endorsed, or administered by, or associated with Instagram. Any questions, comments or complaints regarding this Sweepstakes shall be directed to Sponsor and not to Instagram.
